This newspaper and its editorial staff — both current and former — are the targets of unprecedented grand jury subpoenas dated August 24.

The authorities are also using the grand jury subpoenas in an attempt to research the identity, purchasing habits, and browsing proclivities of our online readership.

It is, we fear, the authorities' belief that what you are about to read here is against the law to publish. But there are moments when civil disobedience is merely the last option. We pray that our judgment is free of arrogance.

These are the issues as we understand them.

In a breathtaking abuse of the United States Constitution, Sheriff Joe Arpaio, Maricopa County Attorney Andrew Thomas, and their increasingly unhinged cat's paw, special prosecutor Dennis Wilenchik, used the grand jury to subpoena "all documents related to articles and other content published by Phoenix New Times newspaper in print and on the Phoenix New Times website, regarding Sheriff Joe Arpaio from January 1, 2004 to the present."

Every note, tape, and record from every story written about Sheriff Arpaio by every reporter over a period of years.

In addition to the omnibus subpoena, which referred to our writer Stephen Lemons directly, reporters John Dougherty and Paul Rubin were targeted with individual subpoenas.

More alarming still, Arpaio, Thomas, and Wilenchik subpoenaed detailed information on anyone who has looked at the New Times Web site since 2004.

Every individual who looked at any story, review, listing, classified, or retail ad over a period of years.

The seemingly picayune matter of Sheriff Arpaio's home address getting printed at the bottom of an opinion column on our Internet site — and the very real issue of commercial property investments the sheriff hid from public view — have now erupted into a courtroom donnybrook against a backdrop of illegal immigration disputes, Mexican drug cartels, the Minutemen, political ambition, and turf disputes between prosecutors and the judiciary.

And given the diva-like drama that Arpaio attaches to even the mundane, you can add to the grand jury tension the paranoia of a Keystone Kops assassination "plot" against "America's toughest sheriff."

Behind these operatic and public developments, an ethical stain has spread over the secret proceedings of the grand jury.

Special prosecutor Wilenchik has sabotaged the integrity of the investigation.

Not content with using the hidden power of sweeping grand jury subpoenas, the government's lawyer attempted to get the ear of the sitting judge — out of earshot of New Times' attorneys.

Special prosecutor Wilenchik used a politically potent emissary in a behind-the-curtain attempt to set up a meeting between the judge overseeing the grand jury and Wilenchik.

In a hastily called hearing October 11, the judge labeled Wilenchik's attempt to set up an ex parte discussion "absolutely inappropriate."

In our humble opinion, Wilenchik's clumsy intervention behind the scenes with the judge was well beyond "inappropriate." Wilenchik's behavior raised the issue of an attempt to rig a grand jury already veiled in official secrecy.

In our deliberations, we faced the obvious: A grand jury investigation is a fearsome thing; a tainted grand jury is a tipping point.

We intend now to break the silence and resist.

This is hardly the first time — even if the scope here is breathtaking — that law enforcement attempted to use a grand jury to get at the confidential records of reporters or editors. But the contemptuousness of this troika of ambitious politicos is reflected in their attempt to target the readers of New Times.

In a grandiose insult to the Constitution, Arpaio, Thomas, and Wilenchik used the grand jury to subpoena the online profiles of anyone who viewed four specific articles on the sheriff.

The pertinent section of the secret grand jury subpoena reads, in part: "All internet web site information for the Phoenix New Times internet site related to the web pages . . . [four specific articles on the sheriff]. The information should include, but not be limited to: The Internet Protocol addresses of any and all visitors to each page of . . . [four specific articles on the sheriff]. . ."

Energized, perhaps, by this mugging of Constitutional safeguards, Arpaio, Thomas, and Wilenchik then shot the moon. The grand jury subpoena also demands Web site profiles of anyone and everyone who visited New Times online over the past two and a half years, not merely readers who viewed articles on the sheriff.

The subpoena demands: "Any and all documents containing a compilation of aggregate information about the Phoenix New Times Web site created or prepared from January 1, 2004 to the present, including but not limited to :

A) which pages visitors access or visit on the Phoenix New Times website;

B) the total number of visitors to the Phoenix New Times website;

C) information obtained from 'cookies,' including, but not limited to, authentication, tracking, and maintaining specific information about users (site preferences, contents of electronic shopping carts, etc.);

D) the Internet Protocol address of anyone that accesses the Phoenix New Times website from January 1, 2004 to the present;

E) the domain name of anyone that has accessed the Phoenix New Times website from January 1, 2004 to the present;

F) the website a user visited prior to coming to the Phoenix New Times website;

G) the date and time of a visit by a user to the Phoenix New Times website;

H) the type of browser used by each visitor (Internet Explorer, Mozilla, Netscape Navigator, Firefox, etc.) to the Phoenix New Times website; and

I) the type of operating system used by each visitor to the Phoenix New Times website."

Special prosecutor Wilenchik wants this information on each and every New Times reader online since 2004.

New Times attorneys Tom and Janey Henze responded to the grand jury subpoenas with a motion to quash the overwhelmingly intrusive effort by authorities to seize the newspaper's confidential records, and a motion to make the subpoena public.

  5. Other than make sure that we go to the polls, what can we do to get rid of Arpaio and Thomas? They are an embarrassment to the judicial system and to the State of Arizona. It's hard to believe that in this day and age, these two can have made it as far as they have. These two are more of a danger to society than the illegal aliens. .

  11. The actions of the County Attorney's office, the Sheriff's Office and of Dennis Wilenchik make me embarassed and ashamed to be citizen of this County. Their actions further make me angry and outraged. I look forward to these buffoons getting their comeuppance. There is not enough public humiliation that could be heaped upon them for their gross abuse of their ofice, their power and their public trust.

  32. What's next? Sheriff Arpio is already on the Amnesty International list for violating basic human rights. He's on the same list that people like Hitler would have been on. Now he's taking things one step further by trying to take away our Constitutional rights as well. Maybe Arpio should be jailed and subjected to the same violations of human rights that he subjects others to.
    My question is why haven't the Feds stopped this man? The city where I am from was cleaned up by the Feds for violations of human rights, but in no where near the severity of this county's department.
    It is a proven fact that the more severe you are on prisoners all you accomplish by this is raising the offender repeat statistics. If you survive the severe treatment you gain status of being big and bad and are idolized. The attitude becomes "If I can survive that, I can handle any jail or prison." It does nothing for rehibilitating offenders,what it does teach is how to be a better criminal.

While the "toughest sheriff in the country" is wasting public money persecuting the New Times, vicious criminals are roaming free and assaulting innocent visitors, like the husband of a colleague, who was robbed, beaten, left in a bathtub with the TV playing loudly and his wrists so tightly bound that gangrene began to set in before he was found. As a result, he lost his left hand and is still trying to regain full use of his right. From what I have been told, other guests at his motel were also attacked but did not suffer such catastrophic injuries. Apparently, drug addicts and dealers were known to frequent the area. Where was the sheriff?

  35. I just read the authors of this piece were arrested last night. What a crock! A waste of taxpayers money! What happened to freedom of speech? I'm all for supporting law enforcement, hell, my dad was a cop for nearly 30 years. We couldn't have our address published either so I can see why the sheriff might not like that but with all the shady dealings the sheriff has a hand in, I guess I'm not too worried for his safety. I hope there's a public outcry regarding the sheriff's stance on many issues and I will continue to have 100% support for the Phoenix New Times. I also hope this arrest brings to light the sneakiness of the sheriff and Candy Andy.

  44. Go ahead and give them my info. Also, let them know I live in NE Phoenix, work full time in a white collar profession, pay my bills and vote. I read my HOA's CC&Rs so I know how many pets I'm allowed to have (and take good care of them), my pool is locked and kept clean so no toddlers can fall in and be hidden in algae. I take the bus to keep Phoenix's air clean. My "babies" are 23 and 27, so there is little likelihood that I will leave them to die unattended in a hot car. I was born in Minnesota and lived there all my life until moving to Phoenix in 1998. I've never been out of the country. I hate to fly. I mostly respect the Phoenix PD and the job they do. I smoke (but not within 20 feet of a business entrance). I drink once in a while (but never drive if I've had even a sip of liquor). I renew my vehicle registration on time every year. I'm not sure if I've visited the New Times Website during the perior in question, but I do pick up the New Times at the bus stop to read frequently. (Does Joe want me to try to get the personal info of the other bus riders who read the New Times while riding?) I visit lots of news websites. If you give them the previous website I visited today, it was AZCentral, and prior to that it was 'Village View' in NY where they're still talking about the story of Carol G being sent alone to Phoenix where I have been defending the actions of Phoenix law enforcement. If he wants to know anything else about me, give him my email address.

    That being said, since when is it a crime to dislike a pompous, grand-standing, arrogant local 'celebrity'? I think his stunts to get in the public eye and get his picture in the newspaper are silly. (i.e. - when he offered to take Paris Hilton in to tent city - what does Paris have to do with Joe? Notta! He just wasn't getting enough attention at the time!) I don't like the man. Never have. Never will. I voted against him last time and I will again next time. Not a crime - simply an American right. And kudos to the New Times for publishing the grand jury summons. I think I'm entitled to know if the grand jury is looking for information about me because I've read a negative article about Joe. They want all personally indentifying information on EVERYONE that visited the newspapers web site since 2004 from anywhere in the world! This and many other requests are clearly against any use of common sense. If this Wacko is allowed to get away with the unprecedented abuse of power then all news agencies and the American people are going to lose in a big way. Freedom of the press and the right of persons to freely view news or other web sites without fear of the government interference are at risk.
    If we are lucky the sheriff will be drummed out of office and get to wear one of his pink prison uniforms. This type of abuse is exactly why antibigbrother com was started.
    These BIG BROTHERS must be stopped and punished for their outrageous actions.

  50. Speaking out in these public forums CAN work. I don't know if anyone here recalls the story from Steamboat Springs Colorado in September 2006 when 2 young men were arrested and thrown in jail for 6 months for taking spoiled veggies out of a trash can. The public outrage on the message board (Steamboat Pilot) over the 4 days of the Labor Day weekend culminated in a televised confrontation between the DA's office, Sherriff's office and local community members, and, ultimately, the immediate release of these 2 "criminals". I was glued to those boards for 4 days, and it was amazing. It worked! These boards are still available if anyone wants to see how the public can make a difference. Here's one of many of them:

    Thirdly, New Times, you have all of our email addresses. If the day ever comes where you actually DO need to appear in court, shoot us an email a few days in advance. It seems our actions are being called into question, too, so we might as well show up to defend ourselves. I would show up in a heart beat to protest this action. It sounds like there are others here who would as well.

I can't wait to receive a subpoena, or find out i was identified by this prosecutor based on my IP address; the next day i will have my attorney sue the prosecutor for invasion of privacy, and i am willing to spend money on this. whether it's the feds or a loser corrupt sheriff somewhere in the desert, we have rights in this country and it's time to show we care about them!

Sounds familiar to me, as small-town law enforcement types tend to have a grandiose view of their powers. In my county, the sheriff has been in power for longer than I've been alive (over 30 years). He actually drives around town in a Cadillac sheriff patrol car - they literally bought him a brand-new Cadillac and installed the lights and cages and all that makes it a patrol car. He also is rumored to have his own network of drug dealers. The cops sell drugs, and they also abuse their power to make crooked business dealings out in the open. We need HONEST LAW ENFORCEMENT! I encourage the newspaper officials to fight this one all the way. You have the support of the nation's public, as you can see.

When we originally moved here from Florida, I had already read about this craziness and actively looked for a house to buy outside of Maricopa County. Happy to say we live in Pinal County. Below is a email sent to the Attorney Generals office by myself, I believe that if we all make our objections known that they will have no choice but to take action against the Communist state being created in the state by Sherriff, County Attorney's Office and Special Prosecutor.     I have been following the Campaign of terror that is being waged by Sherriff Joe Arpaio as well as the County Attorney Thomas and special prosecutor Wilnechik's waging on Phoenix New Times and the First Amendment. I am curious if your office is going to do anything to stop this injustice before it gets out of hand, it already has gone over the lines in requesting the records of anyone who has viewed stories on the Phoenix New Times Website. This is not a communist state or country and the press does have a certain amount of Freedom as do all of the citizens who choose to read their publication. It is appalling to me that the Special Prosecutor could go behind the backs of the Defense Attorneys to try and influence the judge who is hearing the case.

    As a journalism student we have been learning about the laws and the ethics that go along with our line of work, and yet here is a contraversy that effects not only the way we do things but the very fabric of what we do. I hope that not all of the State belongs to Joe and his hinch men as they have been likened to Nazi's frankly at first i thought he was a great sherriff but recent events that have thrust him into the media spot light have turned that opinion sour, placing more value on animal rights than on basic human rights is something that is appalling to me and to anyone who has a sense of justice. Tent cities are great idea however i think he is going over board by declaring himself a victim of the Freedom of Information Act which makes public records of things such as Home address's and business's owned by publice officials. this information is there for anyone with 25 dollars to purchase.

    We are subjected to the laws of this state just like everyone else yet these three gentlemen have placed themselves above those laws, laws that this country was founded on by invading the privacy of the public when requiring that all readers of the New Times since 2004 information be turned over to them. What purpose does this information intend to be used? What right do they have to know what people read? What right do they have to our private information? If we wanted them to know what we were reading we would share it with them.

    Please do something about this before it gets out of hand and tears apart the fabric of our first amendment rights.

    County Attorney Andrew Thomas acknowledges that "mistakes were made" in this prosecution and they didn't feel that they could move forward. Wilenchek will no longer be permitted to prosecute county cases. Sherriff Joe was (for the first time ever) rather camera-shy, saying only that he and his wife are the "victims" in this. Why didn't we get to hear any of his pompous rhetoric tonight?

    Joe, where did you get the money for millions in commercial real estate investments? Inquiring minds want to know!

    Andrew, why did the wife of one of your highest ranking employees contact the judge asking for a closed door conference about the grand jury? Inquiring minds want to know!

    Seriously, if you read the article and follow the chain of events, it become clearer and clearer that this is about the alledged threats against Joe. They've been going on since I moved here in 1998.

    Joe, first of all, let me say that every single peace officer who puts on a uniform and reports for duty, day after day, night after night, runs the risk that they may not go home to their families at the end of their shift. We have 2 recent examples of this, and almost a 3rd. If you can't take the heat of your uniform, get out of it! And if you're so paranoid that someone is going to take a pot shot at you, quit getting on TV and talking tough shit and pissing people off! I loved the way you took Paris on. Come on now, Joe, bullying that little nit-wit? She wouldn't even dare slap you... she's afraid she'd break a nail. So that makes her fair game and shows how tough you really are, right? If you're so darned tough, threats wouldn't bother you.

    Secondly, if you're so concerned about the safety and security of law enforcement officers, how DARE you indite Officer Lovejoy of Chandler over the tragic accidental death of Bandit? You come on TV and make you tough, hard arsed comments that get people riled up, you need to be ready for the consequences. For the record, let's define animal cruelty and abuse. You tie a rope around your dog's neck and tie the other end to your car and drag your dog down the freeway - that's animal cruelty. You douse your cat with lighter fluid and set it on fire - that's animal cruelty. You put a fire craker in your hampster's mouth and light it - that's animal cruelty. You put your dog in a closet in a house with no air conditioning in the middle of July in Arizona with no food and water and leave for a 2 week vacation - that's animal cruelty. Cruelty, by definition, requires INTENT. You deliberately take an action that you know is likely to result in great harm or death. Officer Lovejoy's actions were not intentional. Therefore no cruelty. Therefore no charges.

    Andrew Thomas, you need to look at the above situation too, and probably let that one go as well. While I'm very displeased with your actions in the New Times deal, your withdrawal of the charges gives you a couple of brownie points. Keep them coming.

    (Sigh) - and then there's the Saban situation. All I can say is tsk, tsk, tsk. Dirtiest politics I've ever seen. Joe, were you THAT SCARED that he would get more votes than you?

    I truly hope that the dismissal of the charges against Lacey and Larkin does not end the inquiry into the activities of the elected officials' offices. INQUIRING MINDS WANT TO KNOW!
